Decisions of the Supreme Court of Kosovo
Revision
On revision, the Supreme Court decides by a ruling or a judgment.
By judgment the Supreme Court of Kosovo may decide to:i. uphold revision and modify the challenged judgment;
ii. reject the revision as ungrounded.
i. Uphold the revision and partially or completely annul the first or second instance judgment and refer the case for retrial to the first or second instance court
ii. Annul the challenged judgment by revision and dismiss the claim as inadmissible;
iii. Dismiss the revision as impermissible, incomplete or overdue;
The decision of the Supreme Court shall be served to parties through the Court of Appeals within 30 days. No appeal shall be permitted against a decision on revision rendered by the Supreme Court.
Repeating the procedure
On the proposal to repeat the proceedings, the Supreme Court shall decide by a ruling.
By a ruling the Supreme Court may decide to:
iv. Allow repetition of the procedure and annul the decision rendered in the previous procedure (Article 240.2);
v. Reject the proposal for repetition of the procedure;
Appeal against rulings
• Appeal is not allowed against the ruling allowing the repetition of the procedure and the case is sent back for retrial.
• No appeal shall be permitted against the ruling rejecting the proposal for repeating the procedure.
The appeal shall be submitted to the same court (Supreme Court) which adjudicates through a panel. In this case, if the appeal is upheld, the case is sent back for retrial.
Request for Protection of Legality
On the request to protect legality, the Supreme Court shall decide by a judgment.
No appeal shall be permitted against the decision of the Supreme Court of Kosovo on the request for protection of legality.
Conclusion of civil litigation process
A civil litigation process ends when a decision may not be challenged by any regular or extraordinary remedies.
