The new law on the Special Chamber of the Supreme Court of Kosovo (Law no. 06/L-086 defines the jurisdiction, competencies, the rules governing its operation as well as appointment of judges at this court.
The Special Chamber operates in two instances; first instance, and Appeals Panels, as second instance. Its jurisdiction covers the whole territory of Kosovo. The Chamber is composed of judges who are citizens of the Republic of Kosovo, with at least two (2) judges coming from the non-majority community in Kosovo.
The President of the Supreme Court, and the Supervising Judge who reports to the President for the work of the Special Chamber, are responsible for the operation of the Special Chamber.
Cases which are under the exclusive jurisdiction of the Special Chamber are examined and adjudicated in the First Instance by a single judge, in addition to the privatization process related and property claims. The latter are examined and adjudicated in the first instance by a specialized panel, composed of three (3) judges.
The second instance, the Appeals, which consists of at least two (2) panels of three (3) judges, has the exclusive competence to examine and adjudicate all cases under the exclusive jurisdiction of the Special Chamber, as the final instance.
All cases under exclusive jurisdiction of the Special Chamber, as defined by law, except for privatization process related and property claims, shall be examined and adjudicated in the first instance by a single judge.
Privatization process related and property claims shall be examined and adjudicated in the first instance by a specialized panel, composed of three (3) judges.
At the second instance, the Appeal has exclusive jurisdiction, to examine and adjudicate all cases under exclusive jurisdiction of the Special Chamber as the final instance.
